Terms of Service

These Terms of Service ("Terms") govern your use of the Nebula website, client portal, software, Discord bot, and related services (collectively, the "Service") operated by Nebula ("we", "us", or "our"). By purchasing, downloading, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (16 in the EU/UK) to use the Service. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent and warrant that:

  • You meet the minimum age requirement for your jurisdiction.
  • You are legally capable of entering into a binding contract.
  • You are not barred from using the Service under the laws of your country of residence.
  • All information you provide to us is accurate, current, and complete.

If we discover that you do not meet these requirements, we may suspend or terminate your account without notice and without refund.

2. Licences & Activation

When you purchase a Nebula licence, you receive a limited, non-transferable, non-exclusive, revocable licence to use the Nebula software for the duration stated at the time of purchase. This is a licence to use the software, not a sale of the software itself.

  • Each licence is bound to one active session. You may sign in on different devices, but only one session may be active at a time. Concurrent sessions are not permitted and will result in revocation.
  • Licence keys are tied to you, not to a machine. You may change devices, but you may not share, sell, lease, lend, gift, or otherwise transfer a key to another person, whether for payment or for free.
  • Lifetime licences remain valid for as long as the Service is operational and you comply with these Terms. "Lifetime" refers to the lifetime of the Service, not your lifetime.
  • Time-limited licences (e.g. 30-day, 90-day, 1-year) expire automatically at the end of the purchased period. You must renew to continue using the software.
  • We reserve the right to revoke any licence that violates these Terms, with no refund and no prior notice.
  • Licence keys are delivered instantly and automatically. Once a key is revealed to you, it cannot be "un-revealed". This is relevant to our Refund Policy.

3. Acceptable Use

You agree to use the Service only for its intended purpose and in full compliance with all applicable local, national, and international laws, regulations, and treaties. You are solely responsible for how you use the software, including ensuring that your use does not violate:

  • The terms of service, end-user licence agreements, or rules of any game, platform, or server you interact with.
  • Any applicable law, regulation, or government order.
  • The intellectual property rights or privacy rights of any third party.

Server rules are your responsibility

Nebula is a tool. Many servers permit enhancement clients; some do not. You are responsible for checking the rules of any server you play on before using Nebula on it. We are not liable for any consequence, including bans, loss of items, or loss of access, arising from your use of the software on servers that prohibit it.

4. Prohibited Conduct

You agree not to:

  • Share, sell, lease, lend, gift, or transfer your licence key to anyone else, whether for payment or for free.
  • Run concurrent sessions on the same key, or allow another person to use your key.
  • Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code, internal structure, or algorithms of the software, in whole or in part.
  • Redistribute, republish, repackage, or make the software or any part of it available to others, including via download sites, forums, Discord servers, file-sharing networks, or any other channel.
  • Use the software to develop, test, or train competing products, services, or machine-learning models.
  • Bypass, modify, disable, or interfere with the software's integrity checks, licence validation systems, or any security or anti-piracy measures.
  • Use anonymising services or other techniques to evade abuse detection or circumvent security measures.
  • Attempt to overload, crash, disrupt, or gain unauthorised access to our servers, APIs, databases, or infrastructure (including but not limited to DDoS attacks, SQL injection, brute-force attacks, or credential stuffing).
  • Use automated tools (bots, scrapers, crawlers) to access or interact with the Service, except through officially provided APIs.
  • Use the Service for any unlawful, fraudulent, deceptive, or harmful purpose, including money laundering, fraud, or trafficking in stolen goods.
  • Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
  • Harass, abuse, threaten, or intimidate any person, including our staff, moderators, or other users.

Violations may result in immediate licence revocation, permanent account ban, IP ban, and where applicable, civil or criminal legal action. We reserve the right to report violations to law enforcement or other authorities.

5. Accounts & Security

  • You are responsible for maintaining the confidentiality of your account credentials (username, password, and any associated tokens).
  • You are responsible for all activity that occurs under your account, whether authorised by you or not.
  • You must choose a strong, unique password and not reuse it across other services.
  • Notify us immediately via Discord if you suspect unauthorised access to your account, a compromised key, or any other security issue. We are not liable for losses caused by delayed notification.
  • We are not liable for losses caused by compromised credentials you failed to secure, including weak passwords, shared passwords, or phishing.
  • Accounts may be suspended or terminated at our discretion for violations of these Terms, suspicious activity, or security concerns.
  • You may delete your account at any time by contacting us via Discord. Account deletion is irreversible and will remove access to all associated licences, downloads, and settings.

6. Payments & Billing

  • Pricing is displayed on the website in your selected currency at the time of purchase. Prices are subject to change without notice for future purchases; purchases already completed are not affected.
  • Payments are processed by third-party payment processors (e.g. Stripe). We do not see, store, or have access to your full card number, CVV, or other sensitive payment details.
  • Licence keys are delivered automatically by email and Discord DM within 60 seconds of successful payment. If you do not receive your key, check your spam folder first, then contact us via Discord.
  • You are responsible for providing a valid, accessible email address at checkout. We are not liable for non-delivery due to an incorrect, undeliverable, or unmonitored email address.
  • All taxes, duties, and fees imposed by your jurisdiction are your responsibility unless included in the displayed price.
  • We reserve the right to refuse or cancel any order at our discretion, including orders that appear fraudulent. In such cases, any payment already received will be refunded in full.

7. Refunds

Refunds are governed by our Refund Policy, which is incorporated into these Terms by reference. In summary: licence keys are non-refundable once activated, with limited exceptions for non-delivery or platform incompatibility reported within 48 hours of purchase. The full policy, including eligible and ineligible scenarios, the request process, and chargeback consequences, is available at nebulanetwork.club/refund-policy.

8. Updates & Maintenance

  • The software updates itself automatically on launch. Updates are included for the full duration of your licence at no additional cost.
  • We aim to release compatible builds within 24 hours of each Minecraft Bedrock update. This is a best-effort target, not a guarantee. Some updates may take longer due to the scope of changes.
  • We may temporarily suspend the Service for scheduled maintenance, updates, or emergency fixes. We will endeavour to minimise downtime and schedule maintenance during low-traffic periods. We are not liable for downtime during such periods.
  • We are not obligated to maintain the Service indefinitely. If we decide to discontinue the Service, we will provide reasonable notice (at least 30 days) via email and Discord, and will honour all active licences until their natural expiry. Lifetime licence holders will receive a pro-rata consideration at our discretion.

9. Intellectual Property

The Service, including the Nebula software, website, branding, logos, graphics, text, and all associated content, is owned by Nebula and protected by intellectual property laws, including copyright, trademark, and trade secret laws. Nothing in these Terms grants you any right, title, or interest in the Service except the limited licence granted in section 2.

  • You may not use the Nebula name, logo, or branding for any purpose without our prior written consent.
  • You may not remove, alter, or obscure any copyright, trademark, or other proprietary notices from the software or website.
  • "Nebula", the Nebula logo, and other Nebula trademarks are trademarks of Nebula. All other trademarks are the property of their respective owners.
  • Minecraft is a trademark of Mojang Studios. Nebula is not affiliated with, endorsed by, or sponsored by Mojang Studios or Microsoft.

10. User-Generated Content

If the Service allows you to submit, upload, or share content (such as Discord messages, support tickets, or feedback), you retain ownership of that content. By submitting it, you grant us a worldwide, non-exclusive, royalty-free licence to use, reproduce, and process that content solely for the purpose of operating, improving, and supporting the Service.

You represent and warrant that any content you submit:

  • Does not violate the rights of any third party, including copyright, trademark, privacy, or publicity rights.
  • Is not unlawful, defamatory, harassing, or otherwise objectionable.
  • Does not contain malware, viruses, or other harmful code.

We may remove or restrict access to any content at our discretion, without notice.

11. Disclaimer of Warranty

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee that:

  • The software will function on every device, operating system version, or game version.
  • The software will be uninterrupted, error-free, secure, or free of bugs.
  • The software will produce accurate or reliable results in all scenarios.
  • Your use of the software will not result in consequences from third-party platforms (e.g. server bans, account suspensions, loss of in-game items).
  • Defects or errors will be corrected within any specific timeframe.

You use the software at your own risk. You are solely responsible for any damage to your device, data, or account that results from your use of the Service.

Any advice, guidance, or information provided by our support team is provided in good faith but without warranty. You should verify its applicability to your specific situation before acting on it.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Nebula, its operators, employees, contractors, and affiliates shall not be liable for:

  • Any indirect, incidental, special, consequential, exemplary, or punitive damages.
  • Any loss of profits, revenue, data, use, goodwill, or other intangible losses.
  • Any damage to your device, software, or data.
  • Any consequences arising from your use of the software on third-party servers or platforms, including account bans, loss of in-game items, or loss of access to third-party services.
  • Any unauthorised access to or alteration of your data.
  • Any interruption or cessation of the Service.

Our total aggregate liability for any and all claims arising from or related to these Terms or the Service shall not exceed the amount you actually paid for your licence in the 12 months preceding the event giving rise to the claim, or EUR €20, whichever is greater.

This limitation applies regardless of the legal theory under which the liability is asserted, whether in contract, tort (including negligence), strict liability, or otherwise, and even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Nebula, its operators, employees, contractors, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

  • Your use of the Service or violation of these Terms.
  • Your violation of any law or the rights of any third party.
  • Any content you submit to the Service.
  • Any consequences arising from your use of the software on third-party platforms.

We reserve the right to assume the exclusive defence and control of any matter subject to indemnification by you, in which case you will cooperate with us in asserting any available defences.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violations of these Terms, suspicious activity, or security concerns. Upon termination:

  • Your licence is immediately revoked and you must stop using the software and destroy all copies in your possession.
  • Your account may be deleted or deactivated at our discretion.
  • No refund will be provided unless required by law or our Refund Policy.

You may terminate your account at any time by contacting us via Discord. Sections 9 (Intellectual Property), 11 (Disclaimer), 12 (Liability), 13 (Indemnification), 17 (Governing Law), 18 (Dispute Resolution), and 20 (Severability) survive termination.

15. Third-Party Services

The Service interacts with, depends on, or is built upon third-party platforms and services, including but not limited to Minecraft Bedrock Edition, Discord, payment processors (Stripe), and cloud hosting providers. We are not responsible for:

  • The actions, policies, availability, or content of these third parties.
  • Any changes these third parties make that affect the functionality of the Service.
  • Any data these third parties collect from you under their own privacy policies.
  • Any consequences arising from your use of these third-party services.

Your use of third-party services is subject to their respective terms of service, privacy policies, and community guidelines. You are responsible for reviewing and complying with them.

16. DMCA & Copyright

We respect the intellectual property rights of others and expect our users to do the same. If you believe that any content available through the Service infringes your copyright, you may submit a DMCA takedown notice to us via Discord or email. Your notice must include:

  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the material that is claimed to be infringing, including its location on the Service.
  • Your contact information, including your full name, address, telephone number, and email.
  • A statement that you have a good-faith belief that the use is not authorised by the copyright owner.
  • A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorised to act on their behalf.
  • Your physical or electronic signature.

We will respond to valid DMCA notices in accordance with applicable law. Repeat infringers will have their access terminated.

17. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict-of-law principles. You and Nebula agree to submit to the personal jurisdiction of the courts located within the jurisdiction in which the Service is operated, for any disputes arising from or related to these Terms or the Service.

If you are a consumer in the European Union, you may also bring proceedings in the courts of the EU member state in which you reside, and you may benefit from any mandatory consumer protection laws of that country that cannot be waived by contract.

18. Dispute Resolution

Before initiating any formal dispute resolution, you agree to first contact us via Discord and attempt to resolve the dispute informally for a period of 30 days. Most disputes can be resolved quickly through direct communication.

If the dispute cannot be resolved informally:

  • If you are a consumer in the European Union, you may submit your complaint to the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr, or to your local alternative dispute resolution body.
  • Otherwise, the dispute shall be resolved through binding arbitration rather than in court, except that you may bring claims in small claims court if they qualify. The arbitration shall be conducted by a single arbitrator, in the English language, and the arbitrator's decision shall be final and binding on both parties.

Either party may seek injunctive or other equitable relief in court to protect intellectual property rights at any time.

19. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms to the extent that such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, government actions, labour disputes, power outages, internet or telecommunications failures, hacking or cyberattacks, or failures of third-party services we depend on. We will use reasonable efforts to resume performance as soon as practicable.

20. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. When we make material changes, we will notify registered users via email or Discord at least 14 days before the changes take effect. Changes that are non-material (corrections of typos, clarifications, or administrative updates) may be made without prior notice.

Continued use of the Service after the effective date of any revised Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and may request a refund in accordance with our Refund Policy (if within the eligible window).

21. Severability & Entire Agreement

Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

Entire Agreement. These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Nebula with respect to the Service, and supersede all prior or contemporaneous communications, proposals, and understandings, whether oral or written. No waiver of any provision of these Terms shall be effective unless in writing and signed by us.

Assignment. You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction. Any attempted assignment in violation of this section is void.
